The present general conditions of online purchase and sale shall apply between the company PRODUCTOS DEPORTIVOS, S.A. (hereinafter referred to as ‘LAKEN’), and any person who makes an online purchase through the website www.laken.es.

The parties shall mean LAKEN and any customer who enters into a purchase relationship through the www.laken.es website.

The parties agree that their relationship shall be governed exclusively by these general terms and conditions of sale, which are accessible on the website www.laken.es and must, in any case, be previously accepted by the customer. In case of modification of the same by Laken, the conditions to be applied to each user, will always be those accepted at the time of purchase.

In compliance with the duty of information stipulated in Article 10 of Law 34/2002 of July 11, 2002 on Information Society Services and Electronic Commerce, LAKEN, as the owner of the website www.laken.es, proceeds to communicate the identification data required by the aforementioned regulation:

The present information regulates the conditions of use, the limitations of responsibility and the obligations that the users of the web page published under the domain name www.laken.es, assume and undertake to respect.


Pricing policy

The prices set on the website are indicated in euros including VAT in each of them. The prices are shown excluding shipping costs.

The retail price of the article will always be indicated at the time when the internet user has completed the shopping basket, and the customer will be informed of the final price of his purchase before validating the payment. The prices indicated for each item are binding for the shop where the purchase is made by the customer.

The shipping costs for each order are calculated in real time on the basis of the weight and dimensions of the customer's shopping basket, as well as the customer's delivery address, as a general rule.

In any case, the shipping costs will be recalculated at each moment when the purchase is made on the website, and will appear at all times in the customer's shopping basket, clearly differentiated from the price of the item/s included in it.

The customer will be informed of the final price of their purchase, including the transport of the same, before validating the payment.


Shipping method and delivery times

For purchases made through this website, LAKEN only delivers to Spain and Portugal, with the exception of the Canary Islands, Ceuta and Melilla.

For online purchases, LAKEN undertakes, upon receipt of the purchase request made by the user, to take the user's request into consideration and will proceed, if necessary, to validate/confirm the purchase/sale in whole, in part or in full, in order to enable the user to accept the purchase/sale and thus formalise the purchase/sale.

LAKEN undertakes to notify the internet user of the status of their order, by e-mail, telephone call (the latter in the event that Laken has not been able to confirm the total availability of the order) and/or update the order in the customer's personal space, which can be accessed by clicking on ‘My account’.

In the event that the confirmation of purchase and sale is made for all the products selected, LAKEN will contact the internet user by email, informing them of the products purchased as well as the price of transport and the status of the order. LAKEN will file the electronic document formalising the sales contract, which will be accessible to the customer via the My Account link. The purchase contract will be formalised in Spanish.

In the event of partial confirmation of the purchase-sale due to the unavailability of certain selected products, LAKEN will contact the customer informing him/her of the products finally affected by the purchase-sale by e-mail, telephone and/or by updating the order in the customer's personal space, which he/she can access by clicking on ‘My account’. LAKEN will file the electronic document formalising the sales contract, which will be accessible to the Customer via the link My Account. The purchase contract shall be formalised in Spanish.

In the event that the purchase contract is not confirmed due to the unavailability of all the products selected, LAKEN will inform the internet user that the purchase cannot be completed by telephone, by email and/or by updating the order in the customer's personal space, which the customer can access by clicking on ‘My account’.


Conditions of return

The purchaser may freely withdraw from the contract within thirty (30) days from the date of delivery of the product, i.e. from the conclusion of the sales contract.

The customer shall have the option at any time to withdraw from the purchase, even after confirmation by LAKEN by e-mail to the address laken@laken.es, and the amount previously charged to the customer shall be refunded, provided that the customer's order has not already been sent to the addressee at the time of receipt of the request by the customer.

If this is the case, the customer must wait until the order is received to request a refund, and once the order returns to our warehouse, and the warehouse checks that both the condition and the returned product(s) are in perfect condition, the customer will be refunded the amount of the purchase, excluding shipping costs.

LAKEN will only accept returns in the same means of payment, only for those items purchased directly through the website www.laken.es. To request the return of all or part of the order, the buyer must contact LAKEN customer service via laken@laken.es or telephone +34 968 880 850 (Monday to Friday from 9:00 a.m. to 6:30 p.m., national call price).

Once the buyer sends the products to be returned to our warehouse and they are received, the returned items will be checked and, if everything is correct, the amount will be refunded in the same payment method.

It is important to bear in mind that for the refund of the amount corresponding to the article(s) that you are returning, it is essential to keep the packaging of the article(s) in perfect condition. No exchanges will be possible at www.laken.es.

Product warranties

LAKEN guarantees all products distributed by LAKEN in accordance with the applicable laws and the following conditions.

In the event of non-conformity of the product, a period of two (2) years from the time of delivery is recognised for the purchaser to exercise his rights, however, only in the six (6) months following delivery shall it be presumed that the lack of conformity already existed at the time of delivery, with the purchaser having to prove, in the remaining eighteen (18) months (that is, from the seventh to the end of the two years) that the good was non-conforming, all in accordance with article 114 and following articles of Royal Legislative Decree 1/2007. The consumer has a period of two (2) months from when he/she became aware of the lack of conformity with the goods to notify LAKEN.

In any case, during the time that the consumer is deprived of the product, the warranty period is suspended; for example, if the repair of an item takes 15 days, the warranty period will end 15 days later than originally planned.

The shipping costs incurred in processing the product warranty shall be borne by LAKEN in cases where a lack of conformity is assumed to exist in the purchased good. It will always be under the instructions indicated by LAKEN, upon request and acceptance.

In the event that the product sent does not present the specified fault or this is not covered by the guarantee, it will be returned to the customer with the cost of collection and delivery, and may also be billed for the labour used in checking and/or testing the allegedly faulty item.

The consumer may claim if the purchased good does not conform to the description made by the seller, does not have the qualities that the consumer has seen by means of a sample or model, is not suitable for the uses for which consumer goods of the same type are normally intended, is not suitable for the special use that would have been required by the consumer and that the seller has accepted or does not present the expected quality and behaviour, especially taking into account the public statements (advertising, brochures, labelling...) about its specific characteristics made by the seller or the manufacturer.

LAKEN shall not be liable for any damage resulting from misuse. The guarantee shall not be valid in the event of factors external to the normal use of the product or incorrect or abusive handling by the customer or third parties.

In order to process the warranty, the consumer may do so with LAKEN by following the instructions indicated for this purpose at any time.


Applicable law

These conditions of purchase are governed by the Spanish legislation in force at all times. All disputes arising in application of the aforementioned legislation shall be resolved before the competent courts in accordance with the provisions of consumer and user protection legislation.
